Elle concerne uniquement les 5 types de contrat suivants&nbsp;: les baux \u00e0 usage d&rsquo;habitation, professionnel, commercial, artisanal ou industriel.&nbsp;Cela signifie que pour ces 5 types de contrats cit\u00e9s, il ne sera pas possible de modifier les montants des loyers, et ce pour une p\u00e9riode de 6 mois : \u00e0 compter du 29 f\u00e9vrier jusqu&rsquo;au 29 ao\u00fbt 2024.<\/p>\n<p class=\"CxSpMiddle\">&nbsp;<\/p>\n<p class=\"CxSpFirst\">\ud83d\udcc6&nbsp;<b>2\/4&nbsp;<u>Pourquoi 6 mois uniquement ?<\/u><\/b><\/p>\n<p class=\"CxSpMiddle\">A cause du principe de libert\u00e9 des&nbsp;prix du code de la concurrence ! Ce gel temporaire de la r\u00e9vision des loyers n\u2019a \u00e9t\u00e9 possible que par l\u2019application d\u2019une d\u00e9rogation pr\u00e9vue au dernier alin\u00e9a de l\u2019article LP 110-1 du code de la concurrence&nbsp;:&nbsp;\u00ab\u00a0<i>Le conseil des ministres peut \u00e9galement prendre des mesures temporaires contre des risques de hausse ou de baisse excessives de prix, dont la dur\u00e9e ne peut exc\u00e9der six mois non renouvelables, motiv\u00e9es par une situation de crise, des circonstances exceptionnelles, une calamit\u00e9 publique ou une situation manifestement anormale du march\u00e9 dans un secteur d\u00e9termin\u00e9.<\/i>\u00ab\u00a0<\/p>\n<p class=\"CxSpMiddle\">De ce fait, ce dispositif est EXCEPTIONNEL et ne dure que 6 mois MAXIMUM \u00e0 partir du 29 f\u00e9vrier 2024.<\/p>\n<p class=\"CxSpMiddle\">&nbsp;<\/p>\n<p class=\"CxSpMiddle\">\u2705&nbsp;<b>3\/4&nbsp;<u>Qui EST CONCERN\u00c9 par ce blocage temporaire ?<\/u><\/b><\/p>\n<p class=\"CxSpFirst\">Vous \u00eates concern\u00e9s par ce blocage temporaire si votre bail est l&rsquo;un de ces 5 types de contrat&nbsp;:<\/p>\n<ul>\n<li class=\"CxSpMiddle\"><b>Bail d\u2019habitation meubl\u00e9 ou non meubl\u00e9<\/b>&nbsp;: local&nbsp;\u00e0 usage d\u2019habitation ou \u00e0 usage mixte (professionnel et d\u2019habitation).<\/li>\n<li class=\"CxSpMiddle\"><b>Bail professionnel<\/b>&nbsp;: local destin\u00e9 \u00e0 l\u2019exercice d\u2019un art ou d\u2019une profession, class\u00e9 non commercial selon le code de&nbsp;commerce.<\/li>\n<li class=\"CxSpMiddle\"><b>Bail commercial<\/b>&nbsp;: bail d\u2019une dur\u00e9e de 9 ans concernant un local o\u00f9 est exploit\u00e9 un fonds&nbsp;commercial au sens du code de commerce, ou un local exploit\u00e9 par une personne immatricul\u00e9e au RCS.<\/li>\n<li class=\"CxSpMiddle\"><b>Bail artisanal<\/b>&nbsp;: local destin\u00e9 \u00e0 l\u2019exercice d\u2019une activit\u00e9 artisanale.<\/li>\n<li class=\"CxSpMiddle\"><b>Bail industriel<\/b>&nbsp;: local affect\u00e9 \u00e0 la fabrication ou \u00e0 la transformation de biens, o\u00f9 le r\u00f4le des installations techniques, mat\u00e9riels et outillages mis en \u0153uvre est pr\u00e9pond\u00e9rant.<\/li>\n<\/ul>\n<p class=\"CxSpFirst\">\u00e8&nbsp;Par ailleurs, ce blocage temporaire des loyers ne concerne que les contrats en cours qui se renouvellent&nbsp;: c\u2019est-\u00e0-dire que le propri\u00e9taire et le locataire actuels d\u00e9cident de poursuivre la location.<\/p>\n<p class=\"CxSpFirst\">&nbsp;<\/p>\n<p class=\"CxSpFirst\">\u274c&nbsp;<b>4\/4&nbsp;<u>Qui N&rsquo;EST PAS CONCERN\u00c9 par ce blocage temporaire<\/u>&nbsp;?<\/b><\/p>\n<p class=\"CxSpMiddle\">A part les 5 autres contrats de location&nbsp;cit\u00e9s pr\u00e9c\u00e9demment, tous les autres contrats de location ne sont pas concern\u00e9s par ce blocage temporaire, comme par exemple :<\/p>\n<ul>\n<li class=\"CxSpMiddle\"><strong>Contrat de location \u00e0 caract\u00e8re saisonnier<\/strong>&nbsp;: locations de courte p\u00e9riode (jour, semaine, quinzaine, mois ou saison) telles que Airbnb par exemple.<\/li>\n<li class=\"CxSpMiddle\"><b>Bail \u00e0 construction<\/b>&nbsp;: le preneur s&rsquo;engage \u00e0 \u00e9difier des constructions sur le terrain du bailleur et \u00e0 les conserver en bon \u00e9tat d&rsquo;entretien pendant toute la dur\u00e9e du bail.<\/li>\n<li class=\"CxSpMiddle\"><b>Bail rural<\/b>&nbsp;: contrat de location de terres ou de b\u00e2timents agricoles, permettant l&rsquo;exploitation et l&rsquo;exercice d&rsquo;une activit\u00e9 agricole.<\/li>\n<li class=\"CxSpMiddle\">&#8230;<\/li>\n<\/ul>\n<p class=\"CxSpMiddle\">\u00e8&nbsp;ATTENTION&nbsp;: cette liste est non exhaustive.<\/p>\n<p class=\"CxSpMiddle\">&nbsp;<\/p>\n<p class=\"CxSpFirst\">\ud83d\udd0d&nbsp;<b><u>En r\u00e9sum\u00e9<\/u><\/b><\/p>\n<p class=\"CxSpLast\">Durant la p\u00e9riode allant&nbsp;<b>du 29 f\u00e9vrier au 29 ao\u00fbt 2024<\/b>&nbsp;inclus&nbsp;:<\/p>\n<ul>\n<li class=\"CxSpLast\">Il ne sera&nbsp;<strong>pas possible de revoir \u00e0 la hausse les montants des loyers<\/strong>.<\/li>\n<li class=\"CxSpLast\">Cela concerne uniquement les contrats de location \u00e0<strong>&nbsp;usage d&rsquo;habitation, professionnel, commercial, artisanal et industriel<\/strong>.<\/li>\n<li class=\"CxSpLast\">Tous les autres types de contrats de location, comme par exemple l<strong>es Airbnb et locations saisonni\u00e8res&#8230;, ne sont pas concern\u00e9s par ce blocage temporaire<\/strong>.<\/li>\n<\/ul>\n<p class=\"CxSpLast\">&nbsp;<\/p>\n<p class=\"CxSpLast\">&#8212;<br \/><strong>DGAE<\/strong>&nbsp;|&nbsp;<em>Accompagner et orienter les consommateurs et les
